§ 29.5-10. Tree planting.

  • (a)

    Tree species to be planted. The tree board shall adopt a list of approved species of trees, listed by common name, which shall constitute the official street tree and park tree species for the city. The tree board may modify the list from time to time. A copy of such list of approved tree species shall be kept on file in the office of the city clerk and shall be available to the public for reference during business hours. No species other than those included in such list may be planted as street or park trees without prior approval of the tree board.

    (b)

    Location and spacing.

    (1)

    The spacing of street trees and park trees will be in accordance with the tree species size classes listed in subsection (a) of this section, and no trees may be planted closer together than the following:

    a.

    Small trees, 30 feet;

    b.

    Medium trees, 40 feet: and

    c.

    Large trees, 50 feet; except in special plantings.

    (2)

    The distance street trees may be planted from curbs or curb lines and sidewalks will be in accordance with the three species size classes in subsection (a) of this section, and no trees may be planted closer to any curb or sidewalk than the following:

    a.

    Small trees, two feet;

    b.

    Medium trees, three feet; and

    c.

    Large trees, four feet.

    Exceptions may be made by the tree board.

    (c)

    Prohibited.

    (1)

    No street tree or park tree shall be planted within 35 feet of any street intersection, measured from the point of nearest intersecting curbs or curb lines or within 15 feet of any driveway or alley.

    (2)

    No street tree or park tree other than those species listed as small trees in subsection (a) of this section may be planted under or within ten lateral feet of any overhead utility wire.

    (3)

    No street or park tree shall be planted within ten feet of any fireplug or over or within five lateral feet of any underground water line, sewer line, transmission line or other utility line wire or main.
