§ 12-173. Open fires; when permitted.

  • An open fire is not permitted within the city corporate limits unless an open fire permit has been obtained from the fire chief pursuant to section 12-174. The fire chief shall have the authority to waive the open fire burning ban established by R.R.S. § 81-520.01 for an area within the city corporate limits, such waiver being evidenced by the fire chief issuing an open fire permit, subject to the following:

    (1)

    Conditions for an open fire must be acceptable to the fire chief;

    (2)

    Any person who intends to start an open fire must first obtain an open fire permit. The open fire permit is only effective for a single burning event. A single burning event is any open fire which starts and ends between dawn and dusk of the same day, with a day consisting of the time period between 12:00 midnight and 11:59 p.m. An open fire which continues on to another day requires an additional open fire permit from the fire chief; and

    (3)

    An open fire permit may be issued only for the purpose of burning trees, brush or vegetation of any nature indigenous to and upon the land of the owner or person in lawful possession of the land.
